Terms of Service & Liability Waiver
Last updated: June 12, 2026. Please read these Terms of Service carefully before using WasteLog.uk. By accessing our automated compliance tracking mailbox, receipt validation portals, or API integrations, you agree to be bound by these terms. If you do not agree, you must immediately terminate use.
1. AI Ingestion, Hallucinations, and Verification Duty
WasteLog.uk uses artificial intelligence, optical character recognition (OCR), and language models to identify, extract, and convert data fields (EWC codes, weights, postcodes, carrier CBDU licences) from unstructured documents. You acknowledge that AI and OCR systems are inherently probabilistic and subject to "hallucinations," parsing omissions, transcription errors, and layout misinterpretations.
⚠️ Mandatory Verification Duty: Under Section 34 of the UK Environmental Protection Act 1990 (Duty of Care), the customer remains the sole legal entity responsible for waste tracking accuracy. WasteLog.uk acts strictly as a data-formatting middleware. You retain the absolute duty to log in, review, and confirm all extracted data on your dashboard.
2. Autopilot Mode Liability Waiver
If you enable "Autopilot" or "Auto-Filing" (which automatically pushes parsed notes to government gateway returns without manual review), you do so **entirely at your own risk**. You represent that you have tested our system's extraction accuracy and explicitly waive any rights to claim damages, costs, or losses from WasteLog.uk arising from incorrect data filed programmatically.
3. Strict Limitation of Liability & Damages Cap
To the maximum extent permitted by applicable UK law, WasteLog.uk, its developers, operators, and affiliates shall **never** be liable for any direct, indirect, incidental, punitive, or consequential damages. This includes but is not limited to:
- Civil monetary penalties (VMPs), fixed penalty notices (FPNs), or regulatory fines issued by the Environment Agency, local councils, or DEFRA.
- Business disruptions, loss of trade carrier licences, fly-tipping prosecution, or compliance audit failures.
- Network transmission delays, email delivery failures, or dropped SMS exception alerts.
💥 Liability Cap: In all events, WasteLog.uk's total maximum aggregate liability for any claim under these terms is strictly capped at the total fees paid by the customer to WasteLog.uk in the twelve (12) months preceding the event, or £50, whichever is lower.
4. Customer Indemnification
You agree to fully indemnify, defend, and hold harmless WasteLog.uk and its operators from and against any third-party claims, regulatory enforcement actions, lawsuits, fines, penalties, costs, and expenses (including reasonable legal fees) arising from (a) your use of the services, (b) inaccurate or fraudulent waste transfer data submitted by our platform on your behalf, or (c) any violations of environmental protection laws committed by your business, subcontractors, or waste carriers.
5. Filing Timeframes & Gateway Access
WasteLog.uk handles data asynchronously. You are responsible for ensuring carrier tickets are forwarded to your compliance inbox well in advance of statutory filing windows. We are not liable for late filing warnings resulting from carrier portal delays, email delivery latency, or government gateway API downtime.
6. Governing Law & Jurisdiction
These terms are governed by and construed in accordance with the laws of England and Wales. You agree that any legal action or dispute arising out of your use of WasteLog.uk shall be subject to the exclusive jurisdiction of the courts of England and Wales.
